Terms of Service

1. Acceptance

By signing up to MarbSocial (the “Service”, “we”, “our”) or using it, you confirm that you have read, understood, and agree to these Terms of Service and our Privacy Policy. If you do not agree to any provision, please do not use the Service.

If you use the Service on behalf of an organization, you confirm you have authority to accept the Terms on its behalf.

2. Service description

MarbSocial is a cloud platform for social media management, combining publishing, analytics, AI content generation, inbox management, and automation tools. Supported platforms are listed on the Features page and may change as integrations evolve.

The Service is provided under a SaaS model on an “as is” basis. We continuously develop functionality and may add, modify, or remove features with notice via email or in-app banners.

3. Account registration

• Use of the Service requires registration with a valid email.
• You must be of legal age in your jurisdiction (minimum 16 in EU).
• You agree to provide accurate information and keep it up to date.
• You are responsible for password security. We recommend enabling 2FA.
• Do not share your account with third parties. Single-account use by multiple individuals is prohibited (except team accounts with internal roles).
• Notify us immediately of any unauthorized use of your account.

4. Plans and billing

The Service is offered in Free and paid plans. Plan descriptions and limits are on the Pricing page.

• Paid subscriptions are billed monthly or annually, per the chosen plan.
• Prices may include or exclude VAT depending on your jurisdiction.
• Refunds are available within 14 days of first payment if paid features were not substantially used.
• If unpaid, paid features are blocked; data is retained for 30 days, then may be deleted.
• We may change prices with at least 30 days notice. Your current subscription will not increase before renewal.

5. Acceptable use

By using the Service, you agree NOT to:

• Publish or distribute content that violates the law of your jurisdiction or the recipient's
• Distribute spam, phishing, malware
• Publish material that infringes third-party intellectual property
• Post hate speech, discrimination, or sexual content involving minors
• Attempt to bypass plan limits (rate limits, post quotas) by technical means
• Reverse engineer, copy, sell, or rent the Service without written permission
• Use the Service for attacks (DDoS, brute force) or scanning
• Create multiple accounts to evade limits or sanctions
• Violate the rules of social networks you connect through the Service (Meta Community Standards, TikTok Community Guidelines, etc.)

Violation gives us the right to immediately suspend or delete your account without refund.

6. Use of social networks via Service

By connecting external accounts (Instagram, VK, TikTok, Telegram, YouTube, LinkedIn, Threads, Facebook), you:

• Confirm you have the right to publish on behalf of those accounts
• Accept the terms of those platforms — we are not responsible for their changes
• Understand that platforms may block your account for violating their rules, and the Service cannot prevent this
• Agree that we are not responsible for social platform API changes that may temporarily affect features
• Can disconnect any account at any time via Settings → Connected Accounts

7. AI-generated content

The Service uses generative AI models (Gemini, Claude, Kimi) to create text, images, and other material. By using AI features, you understand that:

• AI may generate inaccurate, biased, or incorrect results — you must review content before publishing
• You are fully responsible for AI content you publish, before law and audience
• Copyright in AI content varies by jurisdiction; we do not guarantee exclusive rights to generated material
• The Service is not liable for third-party claims related to AI content you publish
• You may not use AI features to create disinformation, deepfakes of people without consent, or fraudulent material

8. Intellectual property

8.1 Our IP

MarbSocial, its design, source code, trademarks, logos, and documentation are our property, protected by international copyright. Nothing in these Terms transfers our IP to you, beyond the limited right to use the Service per your plan.

8.2 Your content

You retain all rights to content you upload and create in the Service. We receive only a limited, non-exclusive, revocable license to use your content solely for:

• Storing and displaying content to you
• Processing and publishing to social networks at your request
• Creating backups
• Legal compliance

We do not use your content to train AI models, for advertising, or for resale.

8.3 Feedback

If you send us suggestions, ideas, or bug reports, we may use them to improve the Service without obligation to you.

9. Termination

You can delete your account at any time via Settings → Privacy & Data → Delete Account. Deletion is irreversible: data is erased within 30 days, except data legally required to retain.

We may suspend or terminate access if:

• You violate Section 5 (acceptable use)
• Subscription unpaid for 30 days after blocking
• You use the Service for legally prohibited activity
• We receive a justified complaint from a social network, regulator, or rightsholder

On termination we will provide a data export upon request within 30 days, except in cases of clear violations (fraud, malware).

10. Disclaimer of warranties

The Service is provided “AS IS” and “AS AVAILABLE”, without any express or implied warranties. TO THE MAXIMUM EXTENT PERMITTED BY LAW, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted operation.

We do not warrant that:

• The Service will operate without interruption or errors
• All bugs will be fixed
• Social network APIs will not change
• Published content will reach audiences — that is decided by social network algorithms
• AI generation will produce expected results

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, we are not liable for:

• Indirect, incidental, punitive, special, or consequential damages
• Lost profits, business interruption, reputational damage
• Loss or corruption of data (we recommend keeping your own backups)
• Consequences of social networks blocking accounts
• Damages from AI-generated content you published

Our cumulative liability for all claims related to the Service does not exceed the amount you actually paid for the Service in the past 12 months.

This limitation does not apply in cases of intentional misconduct, gross negligence, or harm to life/health — to the extent such limitation is prohibited by law.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from:

• Your violation of these Terms
• Content you publish through the Service
• Your violation of third-party rights or law
• Your use of AI features to create prohibited material

13. Changes to these terms

We may update these Terms. For material changes, we will notify by email and an in-app banner at least 14 days before taking effect. Continued use after changes take effect means acceptance. If you disagree, you may delete your account before changes take effect.

14. Governing law

These Terms are governed by the laws of the Republic of Poland. All disputes are subject to the competent courts of Warsaw, Poland, except where mandatory consumer rights at your place of residence in the EU apply.

If any provision of the Terms is found invalid, the remaining provisions remain in effect.
